At around 1:30 a.m. on the morning of April 28, 2006, an unknown male walked into the Kwong Chow Congee and Noodle House restaurant, brandished a handgun, confronted a staff member and began to take money from the cash register.

Evan Garber and another restaurant patron intervened, and became involved in a struggle with the robber. Shots were fired, fatally striking Mr. Garber, who died at the scene, and seriously injuring the other patron.
